These Terms and Conditions (hereinafter the "Terms") constitute a legally binding agreement between You and Amrit Mantrah (hereinafter the "Company", "We", "Us" or "Our") governing Your access to and use of the website www.amritmantrah.com, the Amrit Mantrah mobile application and all associated services, content and functionalities (collectively, the "Platform"). This document, being an electronic record within the meaning of the Information Technology Act, 2000 and the rules framed thereunder, does not require any physical or digital signature.
1. Definitions
Wherever the context so requires, "User", "You" or "Your" shall mean any natural or legal person who accesses, browses, registers upon or transacts through the Platform; "Products" shall mean the Ayurvedic, herbal and wellness formulations, including without limitation Trichurna Tablet, offered for sale by the Company; and "Services" shall mean all ancillary offerings including but not limited to consultations, personalised diet routines, progress tracking, recipes and related guidance rendered through the Platform, telephone, WhatsApp or any other medium.
2. Acceptance and Modification of Terms
By accessing, browsing or otherwise using the Platform or placing an order thereon, You signify Your unconditional acceptance of these Terms together with the Privacy Policy, the Refund & Return Policy and all other policies published on the Platform from time to time, each of which is incorporated herein by reference. The Company reserves the right, at its sole and absolute discretion, to amend, modify, supplement or replace any part of these Terms at any time without prior notice, such revisions being effective upon publication and Your continued use thereafter constituting deemed acceptance thereof.
3. Eligibility
Use of the Platform is available only to persons competent to contract within the meaning of the Indian Contract Act, 1872. Persons below eighteen (18) years of age may use the Platform only under the supervision and with the consent of a parent or legal guardian. The Company reserves the right to refuse or terminate access to any User without assigning any reason therefor.
4. Account Responsibility
You shall be solely responsible for maintaining the confidentiality of Your account credentials and for all activities undertaken through Your account, and shall notify the Company forthwith of any unauthorised use thereof.
5. Nature of Products and Health Disclaimer
The Products are Ayurvedic formulations intended to support general wellness and healthy lifestyle practices and are not intended to diagnose, treat, cure or prevent any disease. Nothing contained on the Platform shall be construed as a substitute for professional medical advice, diagnosis or treatment. Results and experiences are inherently subjective and may vary from person to person depending upon factors including without limitation age, physiological condition, dietary habits, physical activity, adherence and pre-existing medical conditions, and testimonials reflect individual experiences and do not constitute a guarantee of similar results. Users who are pregnant, lactating, under medication or suffering from any medical condition including but not limited to hypertension, diabetes or thyroid disorders are strongly advised to consult a qualified medical practitioner prior to consuming any Product. Consultations, diet routines, BMI calculations and other guidance furnished by the Company are general and educational in nature and are not prescriptions or medical opinions.
6. Orders, Pricing and Payment
The placement of an order shall constitute an offer to purchase, which the Company may accept or decline at its discretion, a contract being concluded only upon dispatch or confirmation of acceptance. All prices are denominated in Indian Rupees and are inclusive of applicable taxes unless otherwise stated. The Company reserves the right to revise prices, discounts and offers without prior notice, provided that such revisions shall not affect orders already confirmed, and in the event of any typographical, pricing or technical error, the Company may cancel the affected order and refund any amount paid in full.
7. Shipping, Cancellation and Refunds
Delivery timelines are indicative estimates and may be affected by circumstances beyond the reasonable control of the Company. All cancellations, returns and refunds shall be governed exclusively by the Refund & Return Policy published on the Platform, which forms an integral part of these Terms.
8. User Obligations
You shall not use the Platform for any unlawful, fraudulent or unauthorised purpose, upload or transmit any defamatory, obscene, misleading or infringing content, attempt to gain unauthorised access to the Platform or its systems, or resell the Products without the prior written consent of the Company.
9. Intellectual Property
All content on the Platform, including without limitation text, graphics, logos, product names, images, designs, audio-visual material and software, is the exclusive property of the Company or its licensors and is protected under applicable intellectual property laws. No part thereof may be reproduced, distributed, modified or exploited without the prior written consent of the Company.
10. Communications
By furnishing Your contact details, You expressly consent to receive communications from the Company, including order updates, consultation follow-ups and promotional messages, through telephone, SMS, email, WhatsApp or other electronic means, notwithstanding any registration under the National Do Not Call Registry. You may opt out of promotional communications at any time.
11. Third-Party Links and Services
The Platform may contain links to third-party websites or services, including payment gateways and courier partners, for whose content, policies or practices the Company shall not be responsible.
12. Limitation of Liability
To the maximum extent permissible under applicable law, the Company, its partners, directors, employees and agents shall not be liable for any indirect, incidental, special, consequential or punitive damages arising out of or in connection with the use of, or inability to use, the Platform, the Products or the Services. The aggregate liability of the Company in respect of any claim relating to an order shall not exceed the amount actually paid by You for the Products forming the subject matter of such claim, and the Company does not warrant that the Platform will be uninterrupted, error-free or free from harmful components.
13. Indemnity
You agree to indemnify, defend and hold harmless the Company and its partners, officers, employees and agents from and against any and all claims, losses, liabilities, damages, costs and expenses, including reasonable legal fees, arising out of Your breach of these Terms or Your violation of any applicable law or the rights of any third party.
14. Force Majeure
The Company shall not be liable for any delay or failure in performance resulting from causes beyond its reasonable control, including but not limited to acts of God, epidemics, governmental actions, natural disasters, strikes, civil disturbances or failure of transportation, telecommunication or power networks.
15. Severability and Waiver
If any provision of these Terms is held to be invalid or unenforceable, such provision shall be severed and the remaining provisions shall continue in full force and effect. No failure or delay by the Company in exercising any right shall operate as a waiver thereof.
16. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Republic of India and, subject to applicable consumer protection laws, the courts at New Delhi shall have exclusive jurisdiction over all disputes arising out of or in connection herewith.
17. Grievance Redressal
In accordance with the Consumer Protection (E-Commerce) Rules, 2020 and the Information Technology Act, 2000, any complaint or grievance may be addressed to the Grievance Officer at the contact details provided below, whereupon the Company shall acknowledge the complaint within forty-eight (48) hours and endeavour to resolve the same within one (1) month from the date of receipt thereof.
